WHITE PLAINS, N.Y. — The judge in A&P’s bankruptcy case said Thursday that he was inclined to allow A&P to build a new store at a Bedminster, N.J., site despite reservations from the site’s landlord, but officially adjourned the matter until another hearing Nov. 14.
Judge Robert B. Drain said he would review testimony from A&P and landlord Partners Development, and encouraged the parties in the meantime to pursue a settlement out of court.
As previously reported by SN, Partners sought to have A&P reject a 2009 ground lease that would allow A&P to build a new supermarket in Bedminster, citing concerns that the retailer, currently in Chapter 11 bankruptcy, would not be able to afford the terms of the deal.
