Kroger Warned for Tobacco Act Violation

The Food and Drug Administration warned a Kroger store for selling cigarettes to at least one minor during an FDA State Enforcement Program compliance check in October.

WEST POINT, Miss. — The Food and Drug Administration warned a Kroger store here for selling cigarettes to at least one minor during an FDA State Enforcement Program compliance check in October.

The FDA commissioned state inspectors to visit 493 retailers in Mississippi over the past three months as part of the program. Kroger is one of 25 businesses to receive a warning.

Mississippi was the first state to take part in the initiative that’s designed to enforce provisions of the Tobacco Control Act and implement regulations. A total of 15 states have been awarded contracts to carry out state inspections.

During compliance checks officials observe whether or not the retailer sells a tobacco product to a minor; requests proper identification; sells prohibited flavored cigarettes or individual cigarettes; and has self-service displays, such as vending machines, which can be accessed by minors.
