Whole Foods to Announce New Legal Challenge to FTC

WASHINGTON — John Mackey, chairman and chief executive officer of Whole Foods Market, is expected today to announce details of a new lawsuit in the retailer’s ongoing battle with the Federal Trade Commission. Whole Foods has set a press conference for Tuesday morning here in which Mackey and other Whole Foods executives, along with Steve Cannon, an attorney and a former appointee of the Antitrust Modernization Commission, will ask Congress for “fair play for Whole Foods Market and the FTC.”

The FTC last year sued to stop Whole Foods’ acquisition of Wild Oats even though the deal had closed. Most recently, a U.S. Circuit Court rejected a request by Whole Foods to have the case heard by the full Court of Appeals.
